General Terms and Conditions European Peace Ride

1. General, Scope of the GTC

  1. All deliveries and services are provided exclusively on the basis of the following General Terms and Conditions (hereinafter referred to as "GTC") in the version valid at the time of the order.
  2. The contractual partner is CSM Chemnitzer Sportförderungs- und Marketinggesellschaft mbH, Jagdschänkenstr. 48, 09117 Chemnitz (hereinafter referred to as "Seller" or "we").
  3. The customer within the meaning of these terms and conditions can be either a consumer or an entrepreneur (hereinafter referred to as "Customer"). A consumer within the meaning of the terms and conditions is a natural person who enters into contracts primarily for purposes that are not related to their commercial or professional activity. An entrepreneur within the meaning of the terms and conditions is a natural or legal person or a partnership with legal capacity who, when entering into the contract with the seller, is acting in the course of their commercial or independent professional activity.

2. Conclusion of the Contract, Formation of the Contract

  1. Our offer is binding. By placing your order, you accept our offer to conclude a contract. The contract is concluded upon dispatch of your order to us. You will receive an order confirmation by email.
  2. If you have found the desired product, you can add it to your cart by clicking the [Add to Cart] button. You can view the contents of the shopping cart non-bindingly via the cart graphic. Here you can also delete or modify the products. By clicking the [Checkout] button, you initiate the further ordering process. Here, you will create a customer account with us for your first purchase, choose the payment method, and enter your order details. In the final step, you will receive an overview of your order under "Order Information" and can check and correct or delete any details. You can also correct input errors by navigating backward in the browser or canceling the ordering process and starting again. To complete the purchase, you accept our General Terms and Conditions and submit your order by clicking the [Order with Obligation to Pay] button.
  3. We store your order, the entered order details, and the entire contract text. We will send you a confirmation of your order via email, including all order details and the entire contract text. You also have the option to print both the order and the General Terms and Conditions before submitting your order to us. Finally, you have access to the orders you have made via your customer account at any time.

3. Right of Withdrawal for Consumers

The following right of withdrawal applies only to consumers in distance contracts:

You have the right to withdraw from this contract within fourteen days without providing any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods or has taken possession of them.

To exercise your right of withdrawal, you must inform us (CSM Chemnitzer Sportförderungs- und Marketinggesellschaft mbH, Jagdschänkenstr. 48, 09117 Chemnitz, Phone: 0178/6267500, Email:)   by means of a clear statement (e.g. a letter sent by post or an email) about your decision to withdraw from this contract. You may use the attached model withdrawal form, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send the notification of your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we will refund all payments we have received from you, including the delivery costs (except for the additional costs arising from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and in any event within fourteen days from the day we receive the notice of your withdrawal from this contract. For this refund, we will use the same means of payment you used for the original transaction unless expressly agreed otherwise with you; in any case, you will not incur any fees for the refund. We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You must return the goods to us without undue delay and in any event within fourteen days from the day you inform us of your withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired. You will bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods if this loss in value is due to handling them in a way that is not necessary to establish the nature, characteristics, and functioning of the goods.

5. Prices and Shipping Costs

All prices include the statutory VAT plus shipping costs. We ship with DHL, Hermes, DPD or another provider of our choice.

6. Delivery Conditions

We deliver exclusively within Germany.

The goods will be delivered within 4 days after receipt of your order, unless otherwise stated in the offer.

7. Payment Terms

  1. PayPal: As part of the PayPal Plus payment service, we offer you various payment methods as PayPal services. You will be redirected to the website of the online provider PayPal. There, you can enter your payment details, confirm the use of your data by PayPal, and give the payment order to PayPal.

    If you have chosen PayPal as your payment method, you must be registered with PayPal or register first and authenticate with your login details in order to pay the invoice amount. The payment transaction is carried out automatically by PayPal immediately after confirmation of the payment order. Further information will be provided during the ordering process.
  2. PayPal Express: If you choose the payment method "PayPal Express," the payment processing will be carried out by the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter: "PayPal"), in accordance with the PayPal Terms of Use, available at https://www.paypal.com/de/webapps/mpp/ua/useragreement-full, or if the customer does not have a PayPal account, under the conditions for payments without a PayPal account, available at https://www.paypal.com/de/webapps/mpp/ua/privacywax-full. If the customer selects "PayPal Express" as the payment method during the online ordering process, they also give a payment order to PayPal by clicking the button to complete the order process. In this case, the seller already accepts the customer's offer at the time the customer initiates the payment process by clicking the button to complete the order.
  3. Credit Card via PayPal: If you choose the credit card payment method, you do not need to be registered with PayPal to pay the invoice amount. The payment transaction will be carried out immediately after confirmation of the payment order and after your authentication as the rightful cardholder by your credit card company upon request by PayPal, and your card will be charged. Further information will be provided during the ordering process.
  4. Direct Debit via PayPal: If you choose the direct debit payment method, you do not need to be registered with PayPal to pay the invoice amount. By confirming the payment order, you give PayPal a direct debit mandate.
    After confirming the payment order, PayPal will immediately submit the direct debit mandate and initiate the payment transaction. The payment transaction will be carried out, and your account will be debited. Further information will be provided during the ordering process.
  5. If a payment method offered through the "Shopify Payments" payment service (credit card, invoice with Klarna, pay immediately with Klarna) is selected, the payment processing will be handled by the payment service provider Shopify International Limited, Victoria Buildings, 2nd Floor, 1-2 Haddington Road, Dublin 4, D04 XN32, Ireland (hereinafter: "Shopify"). The individual payment methods offered by Shopify will be communicated to the customer in the online shop of the seller. Shopify may use additional payment services for payment processing, which may have specific terms and conditions, to which the customer may be separately notified. 8. Warranty

  1. If you are a consumer, the warranty is provided according to the statutory provisions.
  2. If you place the order with us as an entrepreneur, the following applies: Delivered goods must be inspected by the customer as far as is practicable in accordance with standard business practices immediately upon delivery. If a defect is found, it must be reported to us immediately. If the customer fails to report the defect, the goods are deemed accepted, unless the defect could not have been detected during the inspection. If a defect is discovered later, the notification must be made immediately after the defect is discovered, otherwise the goods will also be considered accepted with respect to this defect. Section 377 of the German Commercial Code (HGB) remains unaffected. The customer's obligation to inspect applies even in the case of recourse by the entrepreneur under Section 478 of the German Civil Code (BGB). If the customer does not report the defect claimed by their purchaser immediately, the goods are also deemed accepted in respect of this defect. If there is a defect, we are entitled to determine the type of subsequent performance taking into account the nature of the defect and the customer's legitimate interests. Subsequent performance is considered unsuccessful after the third attempt. This clause does not apply in the case of recourse under Section 478 BGB. In the case of subsequent performance, we are only obliged to bear the necessary expenses, particularly transport, travel, labor, and material costs, if these do not increase because the goods were transported to a different location than the customer's registered office or commercial establishment to which the goods were delivered. This clause does not apply in the case of recourse under Section 478 BGB. The customer's warranty claims, including claims for damages, expire after one year. This does not apply in the case of recourse under Section 478 BGB, nor in the cases of Section 438 (1) No. 2 BGB and Section 634a (1) No. 2 BGB. This also does not apply to claims for damages due to injury to life, body, or health or due to gross negligence or willful misconduct by us or our vicarious agents.

9. Legal System, Jurisdiction

  1. German law applies, excluding the UN Sales Convention.
  2. For customers who enter into the contract for a purpose that is predominantly not related to their professional or commercial activity (consumers), this choice of law does not affect the mandatory provisions of the law of the country where the customer has their habitual residence.
  3. For all disputes arising from the contractual relationship, if the customer is a merchant, a legal entity under public law, or a public law special fund, the jurisdiction is determined by the location of our company in Chemnitz.
  4. The European Commission provides a platform for online dispute resolution (ODR). This can be accessed via the following internet address: https://ec.europa.eu/consumers/odr/.

10. Final Provisions

  1. Should individual provisions of these General Terms and Conditions be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions.
  2. In the event of a contradiction between the German and English version of these General Terms and Conditions, the German version shall prevail.
